Posted: Updated: Feb 23, 2015 9:50 PM ESTSAN DIEGO (KUSI) – Federal courts in Texas received a legal brief warning U.S. District Judge Andrew Hanen that if he decides to allow President Obama's amnesty program to move forward, it could cost U.S. taxpayers $144 billion. Sheriff Joe Arpaio said allowing illegal aliens to vote could change the legitimacy of elections in America.
Attorney Larry Klayman of Freedom Watch filed the brief on behalf of Sheriff Arpaio and said states have already reached their own high standards.
U.S. District Judge Andrew Hanen in Texas granted a preliminary injunction that prevented the government from enforcing Obama's amnesty orders.
“To support injunctive relief, plaintiffs must demonstrate;
(1) a substantial likelihood of success on the merits;
(2) that they are likely to suffer ‘irreparable injury' if preliminary relief is not grant;
(3) that an order would not substantially injure other interested parties; and
(4) that the public interest would be furthered by granting the order,” Klayman said.
According to the Justice Department, Hanen needs to let the amnesty program move forward now as Obama has planned.
Klayman said states will be hurt by allowing amnesty.
“Leaving the status quo and injunction in place is the appropriate action,” Klayman said.
Klayman also said allowing the program to move forward would put federal workers in danger of violating the Antideficiency Act, which would “makes it a violation of law, with potential civil and criminal penalties, for government officials to spend funds that have not been appropriated by Congress.”
Klayman said he hopes the ruling will come in his case.
